These terms and conditions apply to the use of the Horeca@Network platform. You accept them when you create an account.
Who we are
Horeca@Network is an initiative of Mohawi BV, Hospitality Group, company number BE 1029 490 001, with its registered office at Bruin de Beerlaan 16, 9111 Sint-Niklaas. You can reach us at hello@horeca.network.
What the platform is
Horeca@Network is a B2B community for the Belgian and Dutch hospitality sector. Businesses browse what other members offer and publish their own promotions, events, vacancies, services and requests. We bring parties together. We are not a party to arrangements members make with each other and do not act as an intermediary for payments between members. The platform is intended for businesses, not consumers.
Your account
- An account belongs to a company. You need a valid VAT number to become a member.
- A company can have several users, each with their own login. The owner manages who has access.
- You are responsible for what happens through your company's logins and you keep your password secret.
- Changing your VAT number is only possible through a request that we review, because the VAT number is what identifies a member as a real business.
- The details you enter must be and remain correct.
Plans
- Joining as a member is free.
- To publish, you choose a plan for providers or buy credits. Which plans exist, what they cost and what they include is shown on the pricing page. All prices exclude VAT.
- A paid plan starts as soon as we approve your request. The invoice follows.
- An annual plan runs for one year. About a month before it ends, we send the invoice for the next year. If it has not been paid by the end date, you move to the free plan below it. If you do not want to renew, let us know before the end date.
- A lower plan starts on the end date of your current plan, so you keep what you paid for.
Credits
- Credits pay for posts, extensions, a place in the newsletter, extra visibility and, where possible, event registrations.
- Credits included with a plan stay valid until that plan ends. Purchased credits stay valid for one year. Whatever is unused by then expires.
- Credits have no cash value. They are not refunded, not converted into money and cannot be transferred to another company.
- If you withdraw a post before it ends, part of the credits comes back according to the rules on the pricing page. A post that has not been approved yet costs nothing.
Invoices and payment
- Invoices are payable within [TO COMPLETE: payment term, e.g. 14 or 30] days.
- If an invoice is not paid on time, you cannot spend credits until it is paid. Your posts stay online. If arrears persist, we may reverse an upgrade or suspend your account.
What you publish
- You remain the owner of your own texts and images. By publishing them, you give us the right to show them on the platform, in the newsletter and in our communication about the platform.
- You guarantee that you hold the rights to what you post, and that it is accurate, lawful and not misleading.
- We review every post before it goes live. We may refuse a post or take it offline, for example for misleading, unlawful or non-hospitality content.
- You honour the promotions you announce yourself. We are not a party to them.
- You use messages and other members' contact details only to do business with that member, not for unsolicited advertising.
Partner placements
Some posts are placed by us on behalf of a partner. They are recognisable as such on the platform.
Events
- For events with registration you pay in euro, in credits or both, as stated with the event. We invoice amounts in euro.
- Up to the number of days before the event stated with the registration, you can cancel free of charge: your credits come back and the euro amount is dropped or credited. After that, everything remains due, even if you do not attend.
- If the event is full, you go on the waiting list. When a place frees up, you move up and your registration applies.
- If we cancel an event, we refund everything you paid for it.
Rewards
With some partner promotions you earn credits when you buy from that partner. The partner confirms your purchase, we approve the claim and grant the credits. We may refuse a claim that is not correct, and take back credits granted on the basis of an incorrect claim.
Availability and liability
- We make reasonable efforts to keep the platform available and secure, but do not guarantee uninterrupted operation.
- We are not liable for content members publish, nor for arrangements members make with each other.
- Our liability is in any case limited to the amount you paid us in the past twelve months, except in case of intent or gross negligence.
Termination
- You can delete your account yourself at any time under My Company, or ask us to do so at hello@horeca.network. Any credits you still have then expire. A running annual plan is not refunded.
- We may suspend or close an account in case of serious or repeated breaches of these terms. Amounts already paid for a running period are not refunded in that case.
Privacy
How we handle personal data is explained in our privacy policy.
Changes
We may change these terms. We inform our members of important changes in advance. If you keep using the platform afterwards, the new version applies.
Governing law
These terms are governed by Belgian law. Disputes are brought before the courts of Dendermonde.
